Man charged with assault with stick in Boulder – Boulder Daily Camera

A man was arrested Sunday on suspicion of hitting another man in the head with a three-foot bat in Boulder.

Daniel Joseph Gardner, 38, was arrested on suspicion of first-degree assault, second-degree assault, drug paraphernalia and unlawful possession of a controlled substance.

He is scheduled to be arraigned on Wednesday and is currently in custody on $5,000 bail.

According to the statement, at 10:10 a.m. Sunday, officers were dispatched to the scene near 30th Street and Shadow Creek Drive.

The witness said he saw a bloody man running out of the woods, chased by a white man in a dark jacket.

The victim was transported to Boulder Community Health for stitches to a laceration to his forehead. He told police he was leaving the tent when Gardner hit him in the face with a baseball bat or a large bat. The affidavit also says he began running toward 30th Street and Gardner chased him.

In an interview with police at the hospital, the wounded man said that the day before the attack, Gardner had been angry about feces found on a trail near their campsite and had confronted him, saying, “I’m going to kill you, I’m going to cut your eyeballs.”

According to the statement, while canvassing the area, officers found a three-foot-long stick with the word “Mage” written on it and discovered “what appeared to be fresh drops of blood 10 to 15 feet away from where the stick was found.”

When questioned by police, Gardner initially denied any involvement in the robbery, claiming he had already left the campsite when the man was injured. He also testified that the man may have fallen on a rock or that he may have self-inflicted injuries, according to the affidavit.
