FIRST ON FOX: : Texas legislators are calling on the federal government to obtain more information about an alleged illegal immigrant accused of killing an American citizen while allegedly driving under the influence.

Thirty-five-year-old Jorge Peralta is accused of an Oct. 13 three-vehicle crash that killed 29-year-old Grayson Davis. According to him, Peralta is accused of escaping and resisting arrest CBS Austin,

He admitted drinking five beers before driving and is currently in ICE custody, the newspaper reported.

Sen. Ted Cruz of Texas wants more information from ICE.

Reps. Michael Cloud, D-Texas, and Sen. Ted Cruz, D-Texas, as well as state Rep. Stan Gerdes say they were told Peralta was an illegal immigrant deported during the Obama and Trump administrations, but that he then returned illegally in 2021.

The Bastrop County Sheriff’s Office confirmed to its offices that it had reported the suspect to ICE and that they had taken him into custody.

“When ICE detains someone, it is because that person is… illegal immigrant i they are interested in them,” said Sheriff Maurice Cook.

Now lawmakers want to know how the suspect re-entered after multiple deportations, whether immigration authorities knew he was in the country and what potential loopholes in law enforcement allowed him to re-enter the U.S.

ICE did not immediately respond to a request for comment, but lawmakers blamed the situation presence of a foreigner in the country in the Biden administration.

“Another family’s worst nightmare has come true, and it’s happening as a direct result of the Biden-Harris administration’s reckless open borders policy,” Rep. Cloud said in a statement.

“Their refusal to enforce our immigration laws has taken another innocent life. How many American citizens must be killed by illegal immigrants before Joe Biden and Kamala Harris decide to act?”

“Another Texan is dead as a direct result of the Biden-Harris border crisis,” Cruz said. “Texans deserve answers as to why this illegal alien was allowed back into our country after being deported twice. This crime was both vexing and avoidable, but the Biden-Harris administration made the cynical decision to keep the border open for political reasons. As a result, crimes are avoidable, vexatious and unacceptable.”

Gerdes said the community is “heartbroken” by the tragedy and that he will push for legislation to address illegal immigration at the state level. All three lawmakers say they want a full investigation into the suspect’s immigration history.

The case comes in the context of a fierce debate over illegal immigration. Republicans tied border crisis and the crimes that have resulted as the Biden administration rolls back from Trump-era policies.

They say ending the border wall, ending “Remain in Mexico” and limiting ICE deportations have encouraged more border crossings. Former President Trump promised to launch a mass deportation operation if re-elected.

The Biden administration has called for the bipartisan border security bill introduced in January, opposed by many conservative Republicans, to increase funding and restrict some entries into the U.S.

She pointed to a sharp decline in the number of encounters at the border since President Biden signed an executive order limiting arrivals in June. Since then, the numbers have dropped by more than 55%. The agency also says it made more than 700,000 moves or returns in FY24, the most since 2010.
