He was arrested during a road rage shooting, but was he even there?

A metro Atlanta man has been charged with pulling the trigger in a 2023 traffic accident. Attorney Ladavious McNair argues her client is not liable because he was in classes and working on his Ph.D. at the time.

“Before you go to jail, you have to do an investigation,” said his lawyer, Marsha Mignott.

Mignott, classmates, fraternity brothers and friends are supporting McNair after he was charged with a street shooting.

According to the statement, the incident occurred in November 2023 near the intersection of Metropolitan Parkway and Ralph David Abernathy Boulevard following an accident. The victim claims McNair pistol-whipped him before shooting him in the knee and driving away.

“Eight days later he himself claimed that he could not choose this person. According to the statement, he chose someone else,” said Mignott, who is raising the alarm on the matter.

Police records show that the victim identified another person as the suspect shortly after the shooting. It wasn’t until August 2024 that the victim took a photo to investigators on social media, claiming that McNair was responsible for the crime.

“The profile doesn’t fit the crime, but they didn’t even want to hear about it,” said McNair’s fraternity brother, Kenneth Love.

Atlanta police say the Flock camera system captured McNair’s car in the area around the time of the incident. People close to McNair say it’s because he was on his way to class.

“How can we compare this type of behavior to a road accident involving a gentleman who was in class while pursuing his Ph.D. “Math is just not math,” Love said.

Mignott claims to have an affidavit from a Clark Atlanta University professor and several classmates stating that McNair was in class at the time.

Many of them are expected to appear in Fulton County Court on Monday morning for a preliminary hearing.

“It could happen to any of us. “Any one of us can be arrested, detained and in an instant our lives can be turned upside down because someone doesn’t want to do their job,” Love said.

His lawyer tells FOX 5 she demanded a nearby video recording that could have included the video as long as he wasn’t responsible for it.
