“If Trump loses the election, he will be at significant risk in federal criminal cases, particularly on the records, if Judge Cannon’s firing under the Appointments Clause is reversed or corrected by the Department of Justice following an appeal,” Germain said.

If elected, Trump has multiple options for dismissing the federal cases, including appointing a sympathetic attorney general to drop the charges or simply issuing a pardon.
