Great Han International Company Pte Limited, which is developing a property development project on Princess Road in Tamavua, has been allowed to continue work.

However, the Environment Tribunal in Nasinu civil jurisdiction has only given the green light to buildings 1 and 2 on level one.

In September this year, the Director of Environmental Affairs filed an ex parte application for a stop work order ordering Qun Ma’s director to stop all work, which was granted.

Qun Ma filed an affidavit in which he sought the lifting of the ex parte order and obtaining permission to complete the construction of buildings 1 and 2 on the first level.

In his statement, Ma highlighted the company’s significant investments in Fiji since 2019, worth more than $15 million.

This development includes the Princess Road project, the Suva Bay hotel, Sigatoka and other commercial properties subject to subdivision for residential and commercial development.

Ma’s lawyer, Feizal Haniff, argued that the request to lift the stop work order was limited to buildings 1 and 2 only.

Haniff also highlighted the financial difficulties his client is facing due to the work stoppage order.

He said lenders had issued demand notices as a result of construction delays.

Environment Tribunal Judge Charles Ratakele said the Director of Environment had raised concerns about potential environmental harm resulting from the project’s location and the stop works order provided an opportunity to address these environmental concerns and ensure the project was delivered in a sustainable manner.

Judge Ratakele said the tribunal would only focus on whether the company would be able to continue work on buildings one and two to complete level three.

The tribunal then ruled in favor of Great Hans, allowing them to complete the construction of Buildings One and Two.
