Elijah McClain’s father sentenced to prison and house arrest for attacking soldiers

Elijah McClain’s father was sentenced to 10 days in jail or house arrest and received 12 months of deferred judgment for assaulting a Colorado State Patrol officer during a DUI arrestAccording to the Arapahoe County District Attorney’s Office.

Lawayne Mosley, 54, was sentenced in Arapahoe County District Court on Monday in connection with a January altercation after pleading guilty to second-degree assault on a police officer and driving under the influence in August.

According to the district attorney’s office, Mosley was sentenced to 10 days in jail with credit for one day, and the sentence may be served under house arrest.

He was also given a 12-month suspended sentence on suspicion of driving under the influence.

Mosley was arrested by a police officer on January 20 after another driver reported that he was driving on Interstate 70 and was not maintaining speed, as previously reported.

Mosley failed to comply with the officer’s commands to exit the vehicle, and when the officer “began to help” him out of the car, Mosley attacked him.

Previous reports indicate that Mosley identified himself as McClain’s father during his arrest. McClain, 23, died after he was wrongly arrested in 2019 by Aurora police officers who restrained him by the neck while a paramedic injected him with an overdose of ketamine.

Mosley’s attorney did not immediately respond to a request for comment.
