A Kerala court rejects CPI(M) leader Divya’s bail plea

Kannur: A Kerala court on Tuesday rejected the bail plea of CPI(M) leader PP Divya, who is accused of abetting the suicide of former Kannur Additional District Magistrate (ADM), Naveen Babu.

Principal district and adjudicating judge, Thalassery, KT Nissar Ahammed passed the order rejecting the plea filed by Divya, former president of the Kannur district panchayat. We are waiting for the order details.

Attending his supposedly uninvited farewell ceremony on October 14, Divya criticized Babu for delaying the approval of a petrol pump in Chengalai for several months and noted that he had given the approval just two days after the transfer, hinting that knows the reasons for the sudden acceptance.

The next day, Babu was found dead in his quarters in Kannur.
On October 19, Divya had filed a case in the Thalassery Sessions Court seeking anticipatory bail after the police registered a case of abetment to suicide ADM against her under Section 108 of BNSS.

Babu’s family welcomed the court’s decision.

Reacting to the verdict, Babu’s widow, Manjusha, said: “The person responsible for destroying our lives must be arrested and we will do our best to ensure justice.”

“I have nothing more to say but we will do our best,” Manjusha told reporters at her residence in Malayalappuzha in Pathanamthitta district.
During the hearing of the bail application, Divya told the court that her remarks against ADM were based on corruption complaints received in connection with it.

Divya’s lawyer also informed the court that the Kannur district collector told her about Babu’s farewell ceremony and asked her if she would be present, to which she replied in the affirmative.

Countering Divya’s arguments, the prosecution produced a statement from the Kannur district inspector, which showed that Divya was never invited to the ceremony and that he had asked her not to make any corruption allegations during it.

The lawyer representing Babu’s family said that both he and the prosecution are opposing Divya’s bail plea, especially since she was removed from the post of district panchayat president by the CPI(M) after she was booked for abetting ADM’s suicide.

The lawyer added that the prosecution vehemently opposed the bail request on various grounds, including that Divya’s presentation of these charges was “pre-planned”, that she may have tampered with evidence and that she did not cooperate with the Department of Revenue’s investigation.

The prosecutor’s office also informed the court that no corruption complaints had been filed against Babu.
