Shane Roper files motions to dismiss charges and block evidence – ABC 6 News

(ABC 6 News) – Former Minnesota State Trooper Shane Roper has filed a series of motions in court seeking to have eight of the nine charges against him dismissed.

Roper faces many serious charges including manslaughter and vehicular manslaughterafter he was involved in an accident outside the Apache Mall in May that killed 18-year-old Olivia Flores.

Court documents show Roper chased a driver who allegedly committed a traffic violation on Highway 52. ​​During the pursuit, Roper allegedly reached speeds of 140 mph without using his hazard warning lights before veering onto Highway 14 and crashing in front of the Apache. Shopping mall.

Court documents show that Roper intends to dismiss eight of the nine charges against him, maintaining that the state failed to establish probable cause for the charges against him and failed to prove that the alleged negligence caused Flores’ death.

The motion does not challenge Roper’s ninth charge, misdemeanor careless driving.

Roper’s defense is also seeking to block certain evidence at trial, including his history of speeding and on-duty accidents and his dismissal from the State Patrol.

The defense is also seeking a change of venue, arguing that a fair trial in Olmsted County would be impossible due to the amount of local media coverage of the case.

Roper’s next hearing is scheduled for November 21.
