America’s next top model alum Jenn An is suing Kanye West for allegedly assaulting her by choking her and sticking his fingers down her throat while filming a music video in 2010.

In a lawsuit filed on Friday, November 22 in federal court in New York, the model accused the 47-year-old rapper of staging a “self-production” by asking a camera crew to film him choking while filming the music video for “La.” Roux’s song “In for the Kill”, which featured West in the remix.

Suit, obtained by Rolling Stone, Page six AND TheWrapclaims that An was working as a supporting actress on the Chelsea Hotel music video in September 2010 at New York’s Chelsea Hotel and was wearing only “revealing underwear: when West pointed her out to the crew and said, ‘Give me the Asian girl.’ “

An claimed she told West: “I don’t wear much.” He allegedly replied, “That’s why I chose you,” and she recalled him telling other supporting actors to leave the room.

The model and actress claimed that West (who has he legally changed his name to Ye) was “towering” over her and “breathing heavily” when he suddenly asked the camera crew to take a close-up of her face and used a “vibrating hand” to “mimic forced oral sex.”

“On camera, defendant West began to choke plaintiff with one hand. Then he wrapped his other hand around her neck and continued to choke her with both hands,” he alleges in the lawsuit, per Rolling Stone. “He then stuck several of his fingers down her throat, constantly moving them in and out, and gagged her” for over a minute.

An also claimed that the rapper shouted, “This is art. This is f***ing art. I’m like Picasso,” choking her “in a porn-like gag/deepthroat/BDSM fetish way. “

“The plaintiff had difficulty breathing and felt as if she had temporarily lost consciousness. When defendant West decided he was done with plaintiff, her face was covered in saliva and smeared makeup,” the lawsuit stated.

Universal Music Group (UMG) is also named as a co-defendant in the case, as An accused the company of “failing to investigate” the incident. The lawsuit states that West’s “gendered, hateful and abusive controversies were a brand that was too profitable for Defendant Universal Music to intervene, despite his unlawful conduct.”

An argued that West violated New York’s Gender-Based Violence Act and is asking the judge to have the case tried by a jury for punitive damages, legal fees and “damages for mental, emotional and physical injuries, anxiety, pain and suffering and reputational damage.”

Her lawyers also argue that UMG “systematically discriminates against women by continuing to work with artists with a well-documented history of sexual harassment and discrimination.” The lawsuit also claims that UMG and its affiliated labels, including Interscope Records and “other high-profile industry figures (have) tried to ‘bury’ the incident.”

The final version of the music video does not include any appearances by West and An.

Representatives for West and UMG did not immediately respond to PEOPLE’s request for comment.

He appeared in season 13 ANTM in 2009, taking third place. In recent years, she has become an actress, appearing in Criminal minds AND Mindy’s Project.

This is one of several lawsuits filed against Ye in recent months. Last week, his former Yeezy employee, Murphy Aficionado, filed 12 complaints against him and his companies, Yeezy LLC and Donda Academy, for discrimination, harassment, retaliation and more.

Aficionado accused the rapper of making anti-Semitic comments, including “Jews got (ex-wife) Kim (Kardashian) and my children. West reportedly made discriminatory comments about Aficionado’s Filipino heritage and allegedly told him to remove his “nasty” traditional Filipino tattoos called “Batok.”

In the complaint obtained by PEOPLE, Aficionado — who worked as a project manager at Yeezy for nine months — alleged that he experienced “unlawful termination” and was not compensated for his work. He also alleged that West told him to go into a hotel room where he and his then-girlfriend, Bianca Censorithey had sex and then got dressed a t-shirt with a swastika.

In October, West’s former assistant also sued him accusing him of drugging her and sexually harassing her in a studio session co-hosted by rapper i Sean “Diddy” Combs.

Lauren Pisciotta, who worked for West from 2021 to 2022, alleged in an amended complaint obtained by PEOPLE that West committed sexual battery after he gave her an intoxicating drink.
