The police were called to approx shooting near 44th and Villard on June 29. The victim said three people robbed him and he was taken to hospital where he was treated for two gunshot wounds to his leg.

At the hospital, the complaint says the victim told police he was “hanging out” with three people who had been stealing from him almost every day since May. He began to notice some of his things disappearing when the group spent time together, so he stopped letting them into his house.

According to prosecutors, the victim stated that all four of them had been drinking when he gave one of them a haircut before the shooting. About 10 minutes after returning home, he said all three showed up at his house. He said they looked nervous and tried to push the door open.

The complaint says one of the three men – later identified as Terry – pulled out a gun during a struggle at the door. The victim felt his knee buckle and fell to the floor. The other two men – later identified as Couch and Stevens – then entered the home and stole two guns. The three men then fled the scene.

All three men were charged with first-degree recklessly causing injury and armed robbery. Terry was also charged with possession of a firearm by an adjudicated felon. As part of the plea agreement, Couch pleaded guilty to a charge of first-degree recklessly causing injury. The armed robbery charge was dismissed but read for sentencing.

Court records show a warrant for Darius Stevens’ arrest has been out since July. Marvin Terry was in court on November 25 for a status conference. He is scheduled to return to court on December 5 for a guilty plea hearing.
